A MASSAGE therapist who accused Kevin Spacey of sexual assault has died before the case could go to trial.
The alleged victim, who remained anonymous, came forward last year to say the actor groped him at a house in Malibu, California.
He sued the two-time Oscar-winner for sexual battery, gender violence, battery, assault, intentional infliction of emotional distress and false imprisonment. Spacey, 60, denied the allegations. It has now emerged the accuser has died, leaving the future of the lawsuit in doubt.
The news was revealed in papers filed to the court in California by Spacey’s lawyers. The family has 90 days to get his estate substituted into the lawsuit to continue it.
The case, filed at Los Angeles Superior Court, had moved to a federal court. Earlier this year, prosecutors dropped a sex assault case against Spacey in Massachusetts after the accused stopped co-operating.
